of Attempted Murder, Assault in the First Degree,
and Burglary in the First Degree

On Tuesday, March 21, 2006, Christian Moore (age 32) of Double Springs and Jeffrey Allen Gilbert (age 41) of Russellville, were each convicted in the Circuit Court of Winston County of Attempted Murder, Assault in the First Degree, and Burglary in the First Degree. The verdicts came at the end of a two-day trial before Circuit Judge John Bentley. Jury deliberations lasted approximately thirty (30) minutes.

The testimony during the trial showed that on June 29, 2004, Moore and Gilbert entered the residence of John Thomas Cagle on County Road 107 in Double Springs. Immediately upon entering the residence, both Moore and Gilbert stabbed Cagle with a knife, resulting in multiple wounds to the chest, abdomen, arm, and leg of Cagle.

The sentencing for Moore and Gilbert was postponed until a pre-sentence investigation has been conducted. Since the crimes involved the use of a deadly weapon, each defendant faces a possible sentence of 20 years to 99 years or life on the Attempted Murder and First-Degree Burglary convictions. On the First-Degree Assault conviction, Moore faces a possible sentence of 10 years to 20 years and Gilbert, who is a habitual felony offender, faces a possible sentence of 10 years to 99 years or life.

Deputy District Attorney Paige Vick, who prosecuted the cases, had the following comment following the jury’s verdicts: “I am very thankful for the jury’s verdicts. The actions of the defendants were both senseless and vicious. I hope the verdicts will send a message that such actions will not be tolerated in this circuit.”
